Donation terms

These terms apply while nihilus.dev is in public beta.

The short version
Donations here are voluntary gifts. They are not purchases and do not create a contractual right to receive music, merch, or finished software. Tools on this site stay free and in public beta whether you donate or not. As a discretionary thank-you, donors may receive a download token for courtesy access while this site hosts files. Donations are nonrefundable except for clear mistakes.

1. Voluntary donation, not a sale

A donation made through nihilus.dev is a voluntary contribution to support Nihilus (the band) and BlurpleTech Inc (the software studio, British Columbia). Donating does not create a sale of goods, a purchase, or a contractual right to receive any product or service. Amounts shown on the site are recognition / thank-you thresholds - not a price list for music.

Under British Columbia consumer protection law, fundraising solicitations must not mislead. We state plainly what is hosted today and that download access is a courtesy, not an entitlement.

2. Where the money goes

Donations are processed by BlurpleTech Inc with the band's permission. Funds support:

  • Development of free music software tools for musicians
  • Keeping the band label-free and independent
  • Band financing - recording, production, and creating more content

Charges on your statement may appear as BLURPLETECH INC.

3. Courtesy download access

As a thank-you, donors may receive a randomized download token. The token is the only way to download music from this site. There are no accounts and no passwords - whoever holds the token holds the access. Keep it safe. Opening access is discretionary and may change if the site or catalog changes.

  • $10 cumulative on one token: recognition toward courtesy access to one album (all qualities we publish).
  • Each further $10 cumulative: recognition toward another album when more albums are hosted.
  • $45 cumulative: unlocks the full catalog currently hosted on this site.
  • You can donate any amount (minimum $1) as many times as you like; reusing your token accumulates the total.

Catalog today: this site currently hosts one album (The Nu World Disorder). That means a $10 cumulative token and a $45 cumulative token currently open the same music courtesy. The $45 level still unlocks the catalog. Today that catalog just happens to be one album; as more albums are added, $45 covers all of them without a new donation for each.

Download access is a courtesy while this website hosts downloads. It is not a permanent or lifelong guarantee. If the site goes offline, changes, or we can no longer offer a given file, that does not create a refund or replacement right - donations are not purchases.

4. Nonrefundable

Donations are nonrefundable. The only exceptions are clear donor error - for example a mistyped amount or an accidental duplicate charge. Contact support and we will review it; approval is at our discretion.

5. Public donor board

Every donation appears on the public supporters board with an amount and a display name. If you do not choose a username, your donation is listed as (no username selected). If you later attach a username to your token, it will also apply to your past public donations - we warn you before that happens, and a username cannot be changed once set.

6. Lost tokens

We store only a hash of your token, never the token itself. If you lose it, we cannot look it up. We can re-issue access only if you can prove the original Stripe session (for example the receipt email).

7. Special donor items (future)

We may later offer limited items as a discretionary thank-you. These may include claimable drops and items offered to selected donors. They are not sold. There is no guarantee of receipt, stock, or shipping.
